It depends on the age of consent in the state where she lives. The age of consent is 16 in the state of NY. Some states have an age differential but NY does not. So in NY he won't go to jail if sex was consensual.

Has he been arrested and charged with anything. Her consent and been over the age of consent carrys more weight than the differential.

If in the U.S. it would depend on local state laws. If someone is beyond the age of consent, the older of the two would be brought up on grape charges (minus the g) Grapists don't do so well in the prison system.

Depends on the state and it's laws....in alot of states being 16 means she isnt a minor and can give consent. You said the sex was consentual...she isn't a minor... Knocking her up twice isnt against the law given these two facts. So why would he be looking at jail time??

Never heard of age differential being a factor before, and find it a little strange. Can anyone tell me the reasoning behind this?

Don't think the whole "identifying" part would fly with a judge in a court of law. I'm 5'9" but identify as 6'1"

"A 16 Yr Old Gets Knocked Up Twice" "gets knocked by the same boyfriend twice in a single year" Are you saying she got pregnant twice in her sixteenth year? Did she give birth to the child from the first pregnancy? If thats the case then she wasn't 16 at the first conception, so even if the age of concent is 16, she would only have been 15 when she first concieved. I'm not from the US. so I can't say on the likelyhood of conviction or length of any sentance. The first thing that struck me was she couldn't have been 16 the first time she got pregnant. But it all depends on the detail of course.

Don't think the whole "identifying" part would fly with a judge in a court of law. So only in certain areas of life are we allowed to 'identify' as we want. Apparently so. Suppose the girlfriend could identify as a 'boyfriend' when she's only 16? Is that OK before she's 18? Absolutely it is. I'm shocked at anyone who would restrict how someone identifies age-wise. I suppose it is only a matter of time before society wakes up and becomes 'enlightened' on this matter. People are going to think you're fucked in the head. That's what they used to think about being either male or female. Make Women Female Again
