Lewd and Liability article in comments |

Today is a “two for”. There are plenty of exhibitionists among the BDSM Community. But no matter how exciting you feel exhibitionism is for you, please remember that there are jurisdictions and laws that might find what you do lewd and against the law if reported and you are caught. Nobody wants a police record. Kinda makes jobs searches harder, as well as embarrassing. If you are going to take the risk, know the laws in the area you plan on playing. Next, something we all have to remember, is that nothing in BDSM is above the laws that are written for the public. Unfortunately for us, that means that things like impact play, wax play, nipple torture or face slapping can be considered assault and battery. Bondage and caging can be considered unlawful restraint. And the law does NOT consider consent as an alibi or excuse and CAN hold us liable for a crime. A lot depends on the jurisdiction. Liberal jurisdictions will probably investigate to make sure it IS consensual, then tell you to be more discrete. A conservative jurisdiction might just try and make an example of you. It is always good to be aware of the laws and standards of the local “public” community towards the BDSM Community. Lastly, Dominants are liable for injuries they cause to the submissive. The Dominant is in charge, doing the action that causes injury, responsible for the safety of the submissive. If a Dominant injures a submissive they should bear the cost of medical care, take care of the submissive during any recovery period. Respectable Dominants DO NOT let the injured submissive fend for themselves. Even though both partners know the risks, the Dominant STILL caused the injury. And remember from above, consent is not an excuse for liability. In this case for being responsible for medical care of the submissive, as well as any lawful liability that might arise from it. Which any sane submissive would bring to the attention of the authorities if the Dominant DOESN’T take responsibility for the medical care and leaves the submissive on their own. Risks have rewards AS WELL as responsibilities and liabilities. © 2/2/24 Ronald Dirienzo
